MARCH 4, 1961- THE INDIANAPOLIS STAR PAGE 1 OBITUARIES Dr. Kenneth Jeffries Dies In Lilly Clinic Dr. Kenneth L. Jeffries, 81 years old, 3433 North Central Avenue, longtime Indianapolis physician, died last night in the Lilly Clinic at Marion County General Hospital. A general practitioner who specialized in obstetrics, he was well known as one of the South Side's oldest physicians before his retirement six years ago.

His offices were at 807 Virginia Avenue. A NATIVE of Indianapolis, he returned here in 1907 to join the practice of his father, Dr. William E. Jeffries. When the elder Jeffries was killed by a car in 1909, he took over the practice in the family's Virginia Avenue home.

A 1903 graduate of the Indiana University Medical School, Dr. Jeffries did post graduate work at New York City and was employed at the Eastern Indiana Hospital for the Insane at Richmond before coming to Indianapolis, He was the head of the boxing program at the old Hoosier Mrs. Katie Lambert Dies; Rites Monday Mrs. Katie E. Lambert, 85 years old, 911 North Avenue, died yesterday in her home.

Mrs. Lambert, born in Heidelburg Germany, lived in Indianapolis 40 years. She attended Emerson Baptist Church. Funeral serv. ices will be held at 1 p.m.

Monday in Shirley Brothers Drexel Chapel, with burial in Crown Hill Cemetery. Survivors include five daughters, Mrs. Delena Clark, Mrs. Bernice Erbrich, Mrs. Greda Wenz, Mrs.

Freda Jensen, all of Indainapolis, and Mrs. Veneda McConkey of Dayton, seven grandchildren, and 11 great-grandchildren. James E. Shaff stall Dies; Funeral Monday Funeral services for James E. Shaffstall, 71 years old, 2877 Sutherland Avenue, will be held at 10 a.m.

Monday in Shirley Brothers Central Chapel. Burial will be in Memorial Park Cemetery. Mr. Shaffstall, lifelong resident of Indianapolis, died Thursday in Robert W. Long Hospital.

He retired four years ago after 10 years as a salesman for the Sanderson Cyclone Company of Orrville, 0, Survivors include the widow, Mrs. Anna C. Shaffstall; a son, Albert P. Shaffstall of Indianapolis; a daughter, Mrs. Emma Mickel of Franklin, and six grandchildren.

Company Mrs. Edith Pritchard Dies In California Funeral services for Mrs. Edith Pritchard, 70 years old. former Indiananolis resident, will be held at 7 p.m. Sunday in the Meyer and Abdon Funeral Home, with burial in Floral Park Cemetery.

Mrs. Pritchard died Tuesday at Hollywood, Cal. She had been a resident of California several years. Born in Jefferson County, she was a resident of Indianapolis many vears and was the widow of Guy Harrell Pritchard, former member of the Indianapolis Symphony Orchestra. Survivors include three daughters, Mrs.

Martha Mornof Hollywood, and Mrs. Mary Kasting and Mrs. Shirley Pieper, both of Indianapolis; two sons. Stanton Pritchard of Hollywood and Robert Pritchard of Las Vegas, a sister, Mrs. Louise Dragset of Hamilton, a brother, Wilson Shirley of New Orleans; 14 grandchildren and one great-grandson.

Ferdinand Rentsch Private funeral services for Ferdinand Rentsch, 914 East 14th Street. factory manager for Lewis Meier Co. will be held at 4 p.m. today in Flanner and Buchanan Creek Mortuary. Burial will be in Crown Hill Cemetery.

Mr. Rentsch died Thursday in Methodist Hospital. A native of Germany, he resided in Indianapolis about 60 years and was employed by the Lewis Meirer firm 40 years. He was a member of the Oriental Masonic Lodge, Scottish Rite and Murat Shrine. A sister, Miss Erna Rentach of Germany, survives.

Dame Dies In Hospital; Rites Scheduled Funeral services for Mrs. Jewell A. Dame, 45 years old, 4113 North Campbell Avenue, will be held at 1 p.m. today in Harry W. Moore Arlington Chapel.

Burial will be tomorrow at Nebo, Ky. Mrs. Dame, who had lived in Indianapolis five years, died Thursday in St. Francis Hospital. She was born at Clay, Ky.

Mrs. Dame was a member of Devington Baptist Church at Indianapolis, and was a den mother of Boy Scout Troop 103. She was a member of the Order of Eastern Star at Norwood, O. Survivors are her husband, George H. Dame; a daughter, Mrs.

Georgetta Reed of Gloversville, N.Y.: two sons, DanJohn Dame, both of Indianapolis; her mother, Mrs. Bertha Dorris of Guthrie, a sister, Mrs. Clyde Pearson of Hot Springs, and three brothers, Howard and Winstead Dorris, both of Guthrie, and Harold Dorris of Henderson, Ky. Okla Hershman Dies; Steel Firm's Founder Okla H. Hershman, 33 East 32d Street, retired president and general manager of the former Hershman Steel Company here, died yesterday in a nursing home.

Born at Sheridan, Mr. Hershman resided in Indianapolis most of his, life and founded the steel firm 25 years ago. He owned the old Starlight Marker Company, a tool and die an uf a c- turing firm. He retired from the steel firm eight years due to poor health. ago, Hershman was a veteran of World War I and attended Purdue University and the Indiana University School of Law.

He held an engineering degree from the University of Illinois. He was a member of the Sheridan Methodist Church, Oriental Masonic Lodge, Mcllvaine Kothe Post of the American Legion and Phi Kappa Sigma Fraternity and was a past member of the Columbia Club, Indianapolis Press Club and the Fort Harrison Officers Club. Funeral services will be held at 2 p.m. Monday in the Flanner and Buchanan Fall Creek Mortuary, with burial in Crown Hill Cemetery. Survivors include the widow, man; a Mrs.

Lola McMillian, all of Cleveland, O. John D. Irwin Sr. John D. Irwin 87-yearold retired plumbing contracttor, died yesterday in Methodist Hospital.

Mr. Irwin, 1112 Broadway, was a lifelong resident of Indianapolis. He was a member of Central Avenue Methodist Church and a 50-year member of Oriental Masonic Lodge. Funeral services will be held at 10 a.m. Tuesday in Flanner and Buchanan Fall Creek Mortuary.

A native of Indianapolis, Mr. Simons was a resident of the city for all but 25 years of his life, when he lived at Logans port. He was an employe of the Pennsylvania Railroad 49 years, retiring as roundhouse foreman at the Hawthorne yards in 1956. He was a member of the Wallace Street Presbyterian Church. Funeral services will be held at 2:30 p.m.

Snyder Dies; Rites Monday Mrs. Rosa C. Snyder, 93 years old, 5122 East St. Clair Street, died yesterday in her home. A lifelong resident of Indianapolis, she was a member of Gethsemane United Lutheran Church.

Zapf died Thursday in her home, 326 East 56 Street. Maurice I. Fitzgerald Maurice 1. Fitzgerald, 209 East Beverly Drive, a retired Indianapolis fireman, died yesterday in Marion County General Hospital. Mr. Fitzgerald, a lifetime resident of Indianapolis, retired in 1952.

A native of Italy, Mrs. Sergi had onerated her produce stand for the last 50 years, prior to a six-month illness. She was a resident of 705 Greer Street but was at the home of a niece, Mrs. Camille Joachim. 3001 Meredith Street, at the time of death.

Appellant was sued as guaranlor for three promissory notes executed by corporation, the guarantee being written on back of notes.

Appellant filed motion that appellee be required to set forth agreement by which appellee compromised and settled its claim with the bankrupt corporation, which motion was overruled, and appellant answered the complaint, one of paragraphs setting up the compromise arrangement under the bankruptcy procedures. The court found for the appellee corporation, and appellant moved for new trial, upon grounds the decision not SUS tained by sufficient evidence, W-15 contrary to law, and for newly discovered evidence. Since the parties at pulated the execution and enforcement of notes and mortgage, including the sale under mortagce, and the proceeds applied 10 the notes, there is ample evidence makinq a primo facie case for the appellee, and the decision is sustained by sufficient evidence. The appellant had burden of proving the affirmative answer, and connot now question the sufficiency of the evidence thereunder. It is only where evidence is without conflict and lends to one conclusion that decision will he set aside as contrary to law.

A composition in bankruptcy does not discharge the quarantor, and in order to ruise the question of fallure quarantee 10 aive notice to quarantor, is matter of defense and must be pleaded specially. Appellant did not raise question of notice as affirmative defense, and it. is therefore waived. The discharne in bankruptcy does not affect liability of guarantor, and therefore the decision was not contrary to law. As to newly discovered evidence, 00- pellant could have chtained the evi.
